At Miramar Resort all the property is titled and all transfer of titles is completed through the Notary. Our number one priority when setting up this development was protecting the owners and their rights as owners. All the respective information is collected from the buyer and then all paperwork is completed through the Lawyer/Notary. Mexico is now the number one retirement destination in the world, thus there are many foreign land owners. Since 1993 foreigners have been able to hold title on land in Mexico. The only stipulation that the Mexican Government employs is that the title has to be held in a Mexican bank trust. This was done to protect foreigner's buying property in Mexico, as the bank/lawyer's must check for an absolutely free and clear title. The title is then held in trust at the bank and cannot be transferred without owner's approval.
Do not confuse this with a 99-year lease. When you buy land in Mexico, you are buying it, not leasing it. You may sell the land at any time, and you may leave it to anyone you choose in your will. If you sell it, or bequeath it, the new owner, if a foreigner, must set up a bank trust, just as you did. But in his case, the first 50-year term commences at the time the land is transferred, and does not date from the time you initially purchased the land.
The second option for owning property as a foreigner is to set up a corporation. Foreigner's can own 100% of a Mexican Corporation, thus the foreigner will own the corporation and the corporation will own the title to the property.
